Unlawful Cell Phone Use while Driving, 6/25/08 12 noon
An officer was monitoring traffic on Rt. 23 at Derby line Road (a very dangerous intersection) when a vehicle approached from the south at a high rate of speed. The vehicle passed the marked police cruiser that was parked on the side of the road and preceded through the intersection at over fifty miles-per-hour to the shock of waiting cross traffic. The officer stopped the vehicle on Rt. 23 near Pearson drive and spoke with the sixteen year old male driver from Maple Park who told the officer he didn’t see the stop sign because he was talking on his cell phone. Persons under the age of 18 are prohibited from the use of cell phones while driving. Police observed a vehicle driving on Washington Street with only one headlight and the officer also observed that the driver was not wearing a seatbelt. The vehicle was stopped and the officer spoke with the driver, Tracy L. Mauger 37 yoa of Kingston. The officer noted the distinct odor of alcohol coming from the vehicle and decided to investigate further. Ms. Mauger was arrested and charged with DUI. Her vehicle was impounded and towed from the scene. She was released after posting bond.

An officer observed an individual having trouble with his motorcycle in the alley North of Main Street. The officer approached and spoke with the driver, William :L. Sharpness, 35 yoa of Genoa. The officer immediately noticed signs of alcohol intoxication but the driver, who has been arrested four times for DUI, did not wish to cooperate with the officer’s attempts to determine if he was too impaired to drive. Mr. Sharpness was arrested based on the officer’s observations and his vehicle was impounded for the night. Police stopped a car on Brown Street because the driver was not wearing his seat belt. The officer spoke with the driver, Anthony Brooks 17 yoa of Compton, and the officer noticed the odor of cannabis. The officer deployed the police canine and the dog alerted on the vehicle indicating the presence of cannabis. The officer searched the vehicle and discovered a small amount of the illegal substance. Mr. Brooks was arrested and charged with possession of less than 2.5 grams of cannabis and possession of drug equipment. He was released after posting bond.

Police observed a vehicle disobey the stop sign at Derby line Road and Rt. 23. The officer stopped the car and spoke with the driver, Nathaniel H. Rigg 22 yoa of Woodstock. The officer noticed the odor of alcohol and observed some common signs of alcohol intoxication. After additional investigation Mr. Rigg was arrested for DUI. The officer also discovered drug paraphernalia in the vehicle subsequent to the arrest. Police received a call concerning a vehicle heading into town on Rt. 72 that may have been driven by an intoxicated person. The officer spotted the vehicle traveling West on Main Street and observed it weaving and crossing the center line. The vehicle was stopped on Rt. 72 near the high school. The officer spoke with the driver Melissa K. Drafall 54 yoa of Monroe Center and noticed signs of alcohol intoxication. The officer investigated further and then placed Ms. Drafall under arrest for DUI. Her vehicle was impounded and towed from the scene. She was released after posting bond.
